1. The Promoter of this Prize Draw (the “Prize Draw”) is Minster (a trading name of STARK Building Materials UK Limited - Company Number: 01647362) whose registered office is at Merchant House, Binley Business Park, Harry Weston Road, Coventry, CV3 2TT (the “Promoter”) in collaboration with Actis (a trading name of Actis Insulation Limited - Company Number: 5008629) whose registered office is at Unit 1 Cornbrash Park, Bumpers Way, Bumpers Farm Industrial Estate, Chippenham, Wiltshire, SN14 6RA (the “Collaborator”).
2. The Prize Draw is open to Minster trade or cash account (the “Account(s)”) holders who purchase at least two thousand GBP (£2,000), excluding VAT, of ACTIS products within a single transaction in a Minster branded branch of the Promoter or via www.minsteronline.co.uk (each “Transaction”) between 00:01 on 5th June 2023 and 11.59 pm on 31st July 2023 (the “Promotional Period”) (the “Participants” and each a “Participant”). The Accounts do not include trade accounts or trade cash card accounts of other brands of STARK Building Materials UK Limited. Participants must be aged 18 or over excluding employees of the Promoter (or any other company within the STARK Building Materials UK Limited group) (an “Employee”), an Employee’s immediate family, their agents or anyone else professionally connected with the Prize Draw. If there is any uncertainty as to who may be a Participant, please contact the Marketing Department on +44 7894 993681 whose decision shall be final and binding.
3. Every Participant to complete a Transaction will receive a Love2Shop voucher to the value of fifty GBP (£50) (the “Vouchers”).
4. Each Transaction made by a Participant within the Promotional Period will be one entry into the Prize Draw for the chance to win one £1000 Love2Shop Holiday card www.love2shopholidays.co.uk (the “Prize”). A winner will be selected at random no later than the 4th August 2023 by an independent adjudicator.
5. The Case Study content sent to the following email address - social@minsteronline.co.uk will be selected at random awarded 10 entries into the customer Prize Draw. The content must be based on the products on offer and must have been distributed by Minster. Include: Your company name, the Minster branch you purchased through, Actis Hybrid products used, name of the project, summary of the project, you contact name, phone number and email address. You must accept that you may receive contact from a third party provider to reach out for detail which may be missing to be of use within the Case Study.
6. The Prize will be subject to availability and must be used before its expiry; details of expiry are detailed on the voucher provided to the winner detailing the Prize.
7. Only one Prize to be won.
8. The Promoter reserves the right to extend the Promotional Period, in which case notification will be provided at https://www.minsteronline.co.uk/actis-prize-giveaway as soon as we are able.
9. Any Prize received during the Promotional Period is for the benefit of the Account holder.
10. In relation to this Promotion:
a. Nothing in these terms and conditions shall exclude or limit the Promoter’s or its third party supplier’s liability for death or personal injury caused by their staff or supplier’s negligence or for fraud.
b. Subject to 10a, the Promoter does not accept responsibility for any fault, malfunction, damage, loss or disappointment suffered by a Participant howsoever arising from accepting any Voucher or Prize whether due to any error, omission or other cause by the Promoter or its employees, agents or others.
c. Subject to 10a, the Promoter is not responsible for any damage or loss caused to a Participant (i) which is not reasonably foreseeable when a Participant agrees to these terms and conditions (which occurs automatically when a Participant participates in this Promotion) or (ii) is reasonably foreseeable when a Participant agrees to these terms and conditions but is only indirectly related to a Participant participating in this Promotion.
d. Subject to 10a, the Promoter reserves the right to alter or amend any element of this Promotion, or foreclose this Promotion and cannot be held responsible for failure to deliver for reasons beyond its reasonable control, including but not limited to strike, lock-out, labour dispute, illness, act of God, natural disaster, adverse weather conditions, war, riot, civil commotion, accident, epidemic or pandemic, malicious damage, fire, flood and/or storm, compliance with law or governmental order, rule, regulation or direction, breakdown of plant, machinery or transportation. The Promoter is not responsible for any loss or damage caused to a Participant as a result of any of these occurrences.
e. A Participant agrees to reimburse the Promoter in respect of any damages or any losses suffered by the Promoter resulting from any claim made by a third party in each case in respect of any matter arising from that Participant’s participation in the Promotion in breach of these terms and conditions or from violation of any applicable law or regulation.
11. Subject to 10a, if any details on a Participant’s Account are incorrect meaning that the Promoter is unable to deliver a Voucher or a Prize to the Account holder, the Promoter will use reasonable endeavours to contact the Participant and redeliver the Voucher or the Prize but the Promoter does not accept responsibility for any inability to deliver if for whatever reason it is unable to make contact with the Participant to redeliver.
12. In the event of unforeseen circumstances, the Promoter reserves the right to substitute the Prize with a prize of equivalent value.
13. Accepting any Vouchers and/or the Prize may give rise to a tax liability which will be a winner's responsibility.
14. The Vouchers and the Prize are not transferable, non-refundable and no cash alternative is available.
15. The information of the Guaranteed Prize and Prize draw winner will be shared with the branch of the Promotor branded Minster that the winner is landlorded to (usually the branch that the winner normally trades with) who will contact the Participant to arrange fulfilment of the Prize. If the Promoter cannot contact a winner, or the winner does not provide their address details or other information required by the Promotor within 14 days of contact by the Promoter, or provides incorrect address details, then the Promoter reserves the right to offer the Prize to an alternative entrant into the Prize Draw.
16. The Prize Draw winner agrees to the use of their name, photograph and disclosure of county of residence and will co-operate with any other reasonable requests by the Promoter relating to any post-winning publicity.
17. Unless the Promotor is prevented from doing so by applicable legislation and/or the UK Cap Code, following the end of the Promotional Period, the name of each winner will be available by sending a stamped addressed envelope to the Promoter at Minster, STARK Building Products UK Ltd, Merchant House, Binley Business Park, Harry Weston Road, Coventry, CV3 2TT.
18. Any personal data submitted by a Participant will be used solely in accordance with current UK data protection legislation and the Promoter’s privacy policy at https://starkbuild.co.uk/wp-content/uploads/2023/02/Privacy-Statement.pdf.
19. The Promoter reserves the right to disqualify any Participant /or select an alternative winner in the event the Promoter believes that any Participant has contravened any of these terms and conditions.
20. The Promoter’s decision is final and binding and no correspondence will be entered into.
21. These terms and conditions are subject to English law and the English courts have exclusive jurisdiction in the event of any dispute.
